Introduction

1.1 Who we are. These Terms of Use (“Terms”) govern your access to:

• (a) the Respona website, account console, licensing tools, and related online services (the “Site” or “Account Services”); and
• (b) the forms and survey platform software you install on your own servers, distribution packages, signed license keys, and support (“Licensed Software”; together with Account Services, the “Services”).

Respona is designed primarily for self-hosted / on-premises deployment. Form responses and operational records collected by Licensed Software remain in your environment.

1.2 Who you are. “You” or “Customer” means the individual or legal entity that accesses or uses the Services.

1.3 Acceptance of Terms. By using the Services, you accept these Terms. If you do not agree, do not use the Services.

Changes to these terms

We may change these Terms from time to time. Material changes are notified by email or on the Site. Continued use after changes constitutes acceptance of the revised Terms.

Service availability

Account Services may be modified or interrupted at any time. Unless a separate written SLA applies, we do not commit to uninterrupted availability.

For Licensed Software, you are responsible for infrastructure, backups, and operational uptime.

Privacy policy

Use of the Services is subject to our Privacy Policy. Where we process personal data on your behalf, the DPA applies.

Eligibility and age

The Services are intended for business use by users who are at least eighteen (18) years of age.

Intellectual property

All rights in the Services remain owned by Respona and its licensors. No rights are granted except as expressly stated in these Terms.

“Customer Content” means data, form responses, configurations, and support materials you or your users submit to the Services. Ownership remains with you; you grant us a limited license to process content you submit to the Account Services in order to provide them.

Accounts and use

An account is required for certain Account Services. You agree to provide accurate information and keep credentials confidential.

You may use the Services only in accordance with applicable law and these Terms. Prohibited uses include unauthorized access, interference with security, exceeding license limits, and uploading malicious content.

Licensed software

Subject to payment of applicable fees, you are granted a non-exclusive, non-transferable fixed-term license to install and run Licensed Software in your environment within the purchased term and plan capacity. Licenses are by default not perpetual and do not auto-renew.

You are responsible for deploying, configuring, backing up, and operating the software.

Form data and customer content

Form responses and survey data processed in your environment are under your control. Respona does not receive them unless you send them.

You are responsible for informing form participants, configuring data retention periods, and complying with applicable privacy laws.

Fees, payments, and licenses

Fees are as stated on the pricing page or order document. Fixed-term licenses are purchased as a one-time prepaid payment; continuing after the term ends requires a new license.

Refund terms are described in our Refund Policy. After a license key is generated, digital fulfillment has begun and refunds are generally unavailable.

Customer responsibilities

You alone are responsible for lawful use of the Services, securing your environment, maintaining backups, notices to form participants, and reviewing support uploads.

Respona does not provide legal advice and does not warrant compliance with any particular regulation.

Warranties and limitation of liability

Unless otherwise stated in a signed written agreement, the Services are provided “as is.” To the maximum extent permitted by law, we are not liable for indirect or consequential damages.

Our total liability will not exceed the amounts you paid in the twelve (12) months preceding the event giving rise to liability.

Term, termination, and suspension

These Terms remain in effect while you use the Services. Access may be suspended or terminated for material breach, unpaid fees, or security risk.

Governing law

The law stated in the order document applies. If none is stated, the laws of the Republic of Türkiye apply. In disputes, the parties will first seek resolution in good faith.

Miscellaneous

These Terms, the Privacy Policy, the DPA, and order documents together constitute the entire agreement. Notices may be sent to [email protected].
